Abstract

As known, the legal system foresees different measures aimed at guaranteeing salaries, Social Security debts and health and safety at work of those workers who provide their services in a context of outsourcing; understanding that their situation bears a specific element of vulnerability. The problem is that the injury of the worker´s fundamental rights that derive from the acts carried out by the main company (the client) would, in principle, be outside this protective mantle. Therefore, in the present work, the aforementioned question is analyzed, under the light of the jurisprudence, looking for possible solutions.
