Abstract
The Economic Analysis of Law (AED for their initials in Spanish) introduces an analytical rationality in the field of criminal sciences that, although cannot be defined as completely new, remains novel in Spain. Whereas the AED has been a movement with great impact in other countries (mostly, Anglo-Saxon nations), in Spain it has never been particularly influential. Consequently, in our academic environment its (theoretical and practical) elaboration has been relatively insignificant. This work aims to analyse the notion of AED applied to the criminal context. For this purpose, this inquiry starts with the presentation of some basic concepts, before delving into some general aspects of the Economic Analysis of Law. Subsequently, this article scrutinises the penal dimension of the Economic Analysis of Law, as well as some of its critical crime prevention-related implications. To sum up, this paper aims to map out the potentialities and realities that currently frame the relation of the Economic Analysis of Law and the Spanish penal system.
