Zusammenfassung

The replacement of the parties to the hotel management agreement often occurs in practice due to the constant changes of the operators: hotel chains and hotel owners. The Spanish civil law does not regulate the situations of the contract assignment to another party, the parties are therefore free to determine the relevant provisions of their agreement themselves. It is in this context that the non-disturbance clause is particularly relevant.
