Abstract

We critically analysed the right of employee representatives to algorithmic information, as laid out in article 64.4.d of the Statute of Workers’ Rights. In this way, we delimited the subjective and objective scope of the right. We also determined its virtues and shortcomings, its relationship with other sections of the provision, and the need for reform to adapt the legislation to the new realities of employee representative powers. Nevertheless, pending this legislative amendment, it is through collective bargaining that such powers can be extended (arts. 64.9 Statute of Workers’ Rights and 91 LOPDPGDD). Therefore, we also set out a number of ideas that social agents could use to advance in what is now referred to as «digital co-governance».
