Abstract
This work presents a proposal for the application of mediation in criminal proceedings, taking into account the latest advances in scientific knowledge provided by Neurosciences when referring to the foundation of criminal law. The novelty is that the Neurosciences are committed to neurological treatment as the main form of special prevention as a criminal response; however, I believe that restorative justice, in general, and penal mediation, in particular, can be an alternative to this treatment without undermining the purposes of the sentence to which these theories refer
