La protección animal desde la perspectiva de los elementos esenciales del contratoA propósito de la STC 81/2020, de 15 de julio

Abstract

The STC 81/2020, of l Sth july, has once again highlighted the conflict of competence that exists over the law of obligations and contracts in rhe autonomous regulations. In rhis case, rhe debate has arisen from the perspective of animal protection, insofar as the autonomous regulations introduce lirnitarions that affect borh the object of the conrracts and their subjects. Based on these premises, the aim of rhis study is to determine the competence of these issues that affect animal protection, as well as the treatment that has been given by the autonomous communities. Likewise, the aim is to analyse the new perspectives emerging in state legislation, as well as their implications with regard to rhis specific issue.
