Resum

The Royal Legislative Decree 1/2020, of May 5, which approves the revised text of the Insolvency Law only mentions in its article 151 the insolvent third party holder. Whether this condition is reflected in the preparation of the list of creditors and inventory and, above all, its transcendence at the time of the enforcement of the security interest are the subject of these lines, based on a real example, which reveals the frequent confusion that takes place between this figure and another close one such as that of the non-debtor mortgagor bankrupt.
