Résumé
In its recent Ruling 46/2020, dated 15 June, the Spanish Constitutional Court makes relevant considerations in relation to the power of disposition of the parties. The sentence upholds the claim for protection and concludes that the litigants have the right to waive and unilaterally abandon the jurisdictional proceeding to set aside and arbitral award regulated in articles 40 and 41 of Spanish Arbitration Law. Last, the resolution defines the uncertain concept of public order.
