Abstract

As a general rule, only the parties that have signed an arbitral agreement are bound by arbitration; however, there are exceptional cases in which a non‐signatory party will be compelled to an arbitrate claims. The aim of this paper is to study the extension of the arbitration clause to non‐signatories parties both in comparative Law and in Spanish Law where the judicial doctrine point in a new direction towards the increasing recognition of extending the arbitration clause, under certain conditions.
