Abstract

This paper examines the attacks on sexual freedom committed by eliminating the victim’s will through the use of medicines, drugs or similar substances. This criminal practice, popularly known as "chemical subjugation", is currently punished in the Spanish Criminal Code as a type of sexual abuse. Taking into account the gravity of this conduct and the victim’s inability to express a valid will and consent caused by the use of substances that physically affect him, the aim of this paper is to establish whether they can be punished as cases of sexual assault committed with violence, rather than as a modality of sexual abuse, or if a specific provision should be envisaged to include this kind of cases
