Zusammenfassung

This commentary analyses the final Judgment issued by the Superior Court of Justice of Andalucía on 9 October 2017. The Decision declares that the action to set aside the arbitration award has to be rejected because the Section 9.7 of the Regulation for the implementation of the Transport Management Act allow the Transportation Arbitration Board to take a final decision with the absence of a member of the Arbitral Tribunal.
