Abstract

Transnational trafficking of persons is an expanding criminal phenomenon that seeks to economically benefit from the smuggling of migrants for the purpose of exploitation. It is estimated that this illegal practice moves more than 150,000 million euros a year. Thus, it seems that a proportional fine might be an appropriate sanction in order to prevent this lucrative crime. There is, however, no provision for natural persons in the crime neither in article 177 bis nor in article 318 bis of the Spanish Penal Code. In this light, this commu-nication examines the political-criminal basis of the fine and whether it is appropriate to provide for it in the mentioned criminal offenses. For this, the most recent jurisprudence in this field will be especially considered.
