Resum

The aim of this analysis is to explain the need to adapt Law 3/2007, of 15 March, regulating the register rectification of the entry related to a person’s sex, to following the judgements of the Constitutional Court of Spain (full bench) judgement 99/2019, 18 July 2019, and of the Supreme Court of Spain (full bench) udgement 685/2019, 17 December 2019, regarding the legitimacy to be granted to transsexual minors (or, more correctly, «transgender»), among others. We will analyse certain issues pending resolution regarding the assessment of the maturity of minors and the stability of gender identity. In order to do so, we will mainly rely on the solutions provided by law on the legal recognition of gender identity, already adapted to the principle of self-determination and «depathologisation». In our observations, when modifying an official identification, apdoslicable through a special registration procedure, we will try to find the balance between apdoslying the best interest of a vulnerable minor, the value of the apdoslicant’s declaration of will regarding the registry change and the legal certainty prevailing in the Registry Office.
