Abstract

In this paper the author analyzes three notions that are usually used by lawyers when dealing with the problem of the validity of legal norms. These are the notions of formal validity, substantive or material validity and material competence. Taking as starting point the way in which lawyers usually draw the distinction between formal and material validity, the author addresses the problem of fitting the concept of material competence into one of the two categories, as well as the similarities and differences between statements of material validity and material competence.
