Abstract
Quantifying the amount to be recovered is a key issue in the field of State aid recovery, however there are not either calculation method or jurisprudential criteria set out on this matter. This situation has generated a differentiated approach among the European institutions. The Commission, endorsed by the Court of Justice, considers that the amount to be recovered is always tantamount to the nominal value of the aid granted, whereas the method including economic criteria which takes into consideration both ex ante and ex post circumstances. Under the General Court standpoint, the amount to be recovered might result in a higher or a lower amount than the nominal value. In this context, the European Court of Justice with its judgment of the European Court of Justice of December 21 2016 rejects the General Court's groundbreaking approach and restore the Commission's classic approach regarding the calculation of the reimbursable benefit.
