Abstract

Consensus is an ancient jurisdictional exercise on the Iberian Peninsula. The peaceful settlement (avenencia) or compromise between parties of Andalusian law had its corollary in the legal history. On the basis of the laws and ordinances by which these institutions were governed for centuries this paper analyzes and justifies the appropriateness and effectiveness of arbitration to achieve conciliation on water agreements. Reconciliation on the use and equitable distribution of water is a manifestation of the willingness of irrigators in the Kingdom of Valencia since the early days of King James I. It was considered a path of peaceful in the conflict resolutions since the Andalusian law times; ultimately, the best solution in terms of judicial economy and avoid the application of more serious sentences.
