Abstract

The present study analyzes the potentialities of gender as a category of legal analysis in the interpretation and normative application.. Part of the critical reflection on the prevailing androcentrism in the Law and the rights and in how this has affected the legal and political subjectivity of women. From these premises, the author invites us to reflect on the terms in which the Law has thought (and thinks) of women. And it is that -as he points out- who thinks creates an imaginary and, in this case, a legal imaginary that constructs, profiles and positions the subjects of rights giving them a greater or lesser power and recognizing a central or peripheral place. After a conceptual analysis the study collects in the constitutional sustenance of the teaching of Justice from a gender perspective.
