Apuntes jurídicos-constitucionales sobre la LO 4/2024, de 18 de octubre. Consideraciones jurídicas sobre su tramitación parlamentaria, efectos de su aplicación, y el conflicto de atribuciones entre órganos constitucionales

Abstract

The article analyzes the legal issues arising from the parliamentary processing of Organic Law 4/2024, of October 18, and specifically: (1) which points of the law have generated more legal discussion from the substantive point of view; (2) what interpretation is feasible to give to the majority vote “against” the text in the Plenary of the Senate, without having previously registered amendments or veto in the legally established terms; and, finally (3) in what terms a conflict of attributions between constitutional bodies -as an instrument of jurisdictional control of constitutionality- such as the one announced by the president of the Upper House would have a place.
